Data Broker Terms
Last updated: November 3, 2026
This version is for information only: only the French version is legally binding, including before the courts.
SellWinners is operated by KOKORIKO SAS, 6 rue d'Armaillé, 75017 Paris, France. "We", "us" and "our" in these Terms mean KOKORIKO SAS. KOKORIKO SAS is a French simplified joint-stock company (SAS) with a share capital of €500, registered with the Paris Trade and Companies Register (RCS Paris) under number 933 691 297, VAT number FR53933691297.
These terms apply to every company or person who publishes data on the SellWinners marketplace (a "data broker", "you"). Together with the agreement you sign with us, which sets the data you supply, your share of the revenue and when you are paid, they are the whole agreement between you and us about your data. Where your signed agreement differs from these terms, it prevails. No data is published before we have both signed it.
1. Who can publish data
Only businesses can be data brokers: a registered company or a self-employed professional. Apply with our Sell your data form. We review every application, check your identity, your company and the sanctions lists, and may refuse an application without giving a reason.
2. Your data and your rights to it
You confirm that you own the data you supply or have every right needed to publish it on the marketplace as these terms describe; that it was collected lawfully, respecting the terms of the sites it comes from, intellectual property and database rights, and privacy and data protection law; and that it holds no illegal content, no passwords or payment card data and no special categories of personal data. Tell us before you supply any personal data: we first agree in writing how it is protected. If any of this stops being true, tell us at once.
3. What you allow us to do with your data
For as long as your agreement lasts and anywhere in the world, you allow KOKORIKO SAS to host, copy, process, combine with other data, analyse and display your data, and to make it available to the marketplace's customers through the Service (the website, the API, the MCP server and exports), who may use it under our Terms of Service. What customers obtained while your agreement lasted stays theirs to use under those terms. Your data stays yours. We don't have to publish all of it, and we may refuse, remove or stop offering any part of it.
4. Your responsibility for your data
You alone are responsible for the data you publish: its accuracy, its legality and the rights to it. We make it available as it is, without checking or endorsing it. You describe its source, coverage and update frequency accurately, deliver it in the format and at the pace your agreement sets, and correct the errors you learn about.
5. Complaints and removals
Customers, rights holders, other people and authorities send their complaints about data to us. We pass you every complaint about your data, and you deal with it within 5 business days, or sooner when the law or the complaint's urgency requires. We may remove or suspend any of your data at once while a complaint is open, and for good when it breaks the law or these terms.
6. Customers
Customers subscribe to the marketplace with SellWinners, at the prices and on the terms it sets, and pay SellWinners. You don't contact them through the Service or use what you learn on it to sell to them elsewhere, and we share their personal data with you only when your agreement says so and the law allows it.
7. Revenue share and payment
We pay you the share of the marketplace's revenue that your agreement sets, monthly once your balance reaches the minimum it sets, through the payment provider we use for payouts, to the account you give us. You pass that provider's identity checks, keep your details accurate, send us invoices where the law requires them and pay your own taxes. We may hold back or deduct the share of revenue that is refunded or disputed, and amounts tied to data that breaks these terms.
8. Confidentiality
Each of us keeps the other's non-public information confidential, including your agreement's terms, our prices, our customers and our technical details, while your agreement lasts and for 5 years after it ends.
9. Liability and indemnity
You will cover our losses and reasonable legal costs from any claim caused by your data or by your breach of these terms. Our total liability to you is limited to the amounts we paid you in the 12 months before the claim, except for gross negligence or wilful misconduct.
10. Duration and ending
Your agreement lasts until either of us ends it with 30 days' notice in writing. We may end it at once if you break these terms, if your data is unlawful or the subject of a serious complaint, or if an identity, sanctions or fraud check fails. When it ends, we stop offering your data within 30 days and pay you what we owe for the time before the end.
11. Changes
We may change these terms with 30 days' notice by email. If you don't accept a change, you can end your agreement before it applies.
12. Law and courts
These terms are governed by French law, and the courts of Paris have exclusive jurisdiction over any dispute about them.
Only the French version of these Terms is legally binding, including before the courts; the other versions, English included, are translations for information only.
