Terms of Service

SellWinners is operated by Kokoriko, 6 rue d'Armaille, 75017 Paris, France. "We", "us" and "our" in these Terms mean KOKORIKO SAS.
These Terms govern your use of the SellWinners website, API, MCP server and related services (the "Service"). By creating an account or using the Service, you agree to these Terms.
1. Your account
You must provide accurate information and keep your password and API keys confidential. You are responsible for all activity under your account and keys. Tell us right away at support@sellwinners.com if you suspect unauthorised use. One person or organisation may not create multiple free accounts to get around plan limits.
2. Plans, credits and billing
Each paid plan includes a monthly allowance of credits (one credit for each result returned) and a rate limit for the API and the MCP server, use of the web app (unlimited, subject to fair use), and the data access shown on our pricing page. The Free plan includes the web app and, within the limits shown on our pricing page, the MCP server for AI assistants; it does not include the API. Monthly credits renew on the 1st of each month (UTC) and unused monthly credits don't roll over; top-up credits, bought separately with a one-time payment, carry over and don't expire. Paid plans are billed in advance for the billing period you choose (monthly, quarterly or yearly) through our payment processor, Stripe, and renew automatically for the same period until cancelled. You can cancel at any time; your plan stays active until the end of the paid period. Plan changes take effect immediately and are prorated. We may change prices with at least 30 days' notice; changes apply from your next billing period.
3. Acceptable use
You agree not to: (a) resell, sublicense or redistribute raw data from the Service as a competing dataset or API; (b) share API keys outside your organisation; (c) attempt to bypass rate limits, credit limits or security measures; (d) use the Service for unlawful purposes, spam, harassment or to infringe others' rights; or (e) disrupt or overload the Service. You may use data you retrieve inside your own products, analyses and reports.
The website, including the web app, is for people. You also agree not to: (f) use bots, scrapers, crawlers, scripts or automation frameworks (such as WebDriver, Selenium, Puppeteer, Playwright or a headless browser) to access the website or copy its data; automated access is allowed only through the API or the MCP server, with your own key, while an AI browser assistant acting on your own instructions, in your own signed-in browser and at a normal pace, is allowed; (g) reverse engineer, decompile or work around the website, its code or the requests it makes, including copying those requests to make them outside the website; (h) resell, republish or redistribute the data itself, in whole or in part, as a dataset, a feed or a competing service (using it inside your own products, analyses and client reports stays allowed, as above); or (i) share your account or its sign-in with anyone else: each person uses their own account, and teams use workspace seats.
4. Data and availability
The Service provides information about publicly visible ads, online stores and marketing emails. We work to keep it accurate and available, but data may be incomplete, delayed or inaccurate, and the Service is provided "as is" without warranties of any kind. We may modify, add or remove features and endpoints; we'll give reasonable notice of breaking changes to the API.
SellWinners is a marketplace and broker for data: data on the Service comes from third-party sources, including data partners who supply it through our Data Partners program. Third-party data remains the property of its owners: SellWinners does not claim ownership of it, and your plan gives you access to it, not ownership. 5. Suspension and termination
We may suspend or terminate accounts that breach these Terms, fail to pay, or put the Service or other customers at risk. You may delete your account at any time from your settings.
An account used for automated access to the website, or in breach of section 3 in any other way, is blocked for one day the first time, and closed permanently if it happens again. We tell you by email each time; if you think we made a mistake, contact us at support@sellwinners.com. No refund is issued for an account blocked or closed for breaking these Terms, for the current billing period or any unused credits.
6. Limitation of liability
To the maximum extent permitted by law, SellWinners will not be liable for indirect, incidental, special or consequential damages, or for lost profits or data. Our total liability for any claim is limited to the amount you paid us in the 3 months before the claim.
7. Changes to these Terms
We may update these Terms. If a change is material, we'll notify you by email or in the dashboard before it takes effect. Continuing to use the Service after that means you accept the updated Terms.
